1. Eligibility

You must be at least 18 years old and legally capable of entering into contracts to use the Services. By using the Services, you represent and warrant that you meet these requirements.

2. Description of Services

TerrainTracer is a platform that connects Clients with third-party service providers ("Providers") to obtain non-binding Quotes for land-related services, such as terrain analysis, valuation estimates, or surveying referrals.

• We do not perform land evaluations, surveys, or appraisals ourselves.

• Quotes are provided by independent Providers and are estimates only.

• We do not guarantee the accuracy, completeness, or timeliness of any Quote.

3. User Account

To request Quotes, you may need to create an account. You are responsible for:

• Providing accurate, current, and complete information.

• Maintaining the confidentiality of your account credentials.

• All activities under your account. Notify us immediately of any unauthorized use.

4. Quote Request Process

• Submission: You submit land details (e.g., location, size, photos, description) via the Site or App.

• Matching: We forward your request to qualified Providers.

• Quotes: Providers may respond with Quotes. You may receive multiple Quotes.

• No Obligation: Receiving a Quote does not obligate you to hire the Provider.

• Fees: TerrainTracer does not charge Clients for requesting or receiving Quotes. Providers may pay us a referral fee.

5. Client Responsibilities

You agree to:

• Provide truthful, accurate, and complete land information.

• Use Quotes for lawful purposes only.

• Not misuse Provider contact information (e.g., spam, harassment).

• Indemnify TerrainTracer for any claims arising from inaccurate information you provide.

6. Provider Relationship

• Providers are independent contractors, not employees or agents of TerrainTracer.

• Any agreement to hire a Provider is between you and the Provider exclusively.

• We are not a party to any contract between you and a Provider.

• You are responsible for verifying Provider credentials, licenses, insurance, and suitability.

7. Intellectual Property

• The Services, including all content, logos, and software, are owned by TerrainTracer or its licensors and protected by copyright, trademark, and other laws.

• You are granted a limited, non-transferable license to use the Services for personal, non-commercial Quote requests.

• You may not copy, modify, distribute, or reverse-engineer any part of the Services.

8. User Content

By submitting land details, photos, or other materials ("User Content"):

• You grant TerrainTracer a worldwide, royalty-free, perpetual license to use, display, and share it with Providers solely to facilitate Quotes.

• You represent that you own or have rights to the User Content and it does not infringe third-party rights.

• We may remove User Content at our discretion.

9. Prohibited Activities

You may not:

• Use the Services for illegal purposes.

• Interfere with or disrupt the Services (e.g., viruses, bots).

• Impersonate others or falsify information.

• Scrape or collect data without permission.

• Engage in fraudulent Quote requests.

10. Disclaimers

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

• WE DO NOT WARRANT THAT QUOTES ARE ACCURATE, COMPLETE, OR SUITABLE.

• LAND VALUES AND CONDITIONS FLUCTUATE; QUOTES ARE ESTIMATES ONLY.

• WE ARE NOT RESPONSIBLE FOR PROVIDER PERFORMANCE, DELAYS, OR DISPUTES.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• TERRAINTRACER SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, EVEN IF ADVISED OF THE POSSIBILITY.

• OUR TOTAL LIABILITY SHALL NOT EXCEED $100 USD. Some jurisdictions do not allow these limitations, so they may not apply to you.

12. Indemnification

You agree to indemnify and hold harmless TerrainTracer, its affiliates, officers, and employees from any claims, losses, or damages (including attorney fees) arising from your use of the Services, violation of these Terms, or interactions with Providers.

13. Termination

We may suspend or terminate your access at any time for any reason, including violation of these Terms. Upon termination, your right to use the Services ceases immediately.

14. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict of laws principles. Any disputes shall be resolved exclusively in the state or federal courts located in Wilmington, Delaware. You agree to personal jurisdiction there.

15. Changes to Terms

We may update these Terms at any time. Changes will be posted on the Site with the new Effective Date. Continued use after changes constitutes acceptance.

16. Miscellaneous

• Entire Agreement: These Terms constitute the entire agreement between you and TerrainTracer.

• Severability: If any provision is invalid, the remainder remains in effect.

• No Waiver: Failure to enforce a right does not waive it.

• Assignment: You may not assign your rights; we may assign ours.

• Force Majeure: We are not liable for delays due to events beyond our control.
